Samuel D. Orbovich, J.D., Orbovich & Gartner Chartered
Sam has practiced law since 1978. He practices primarily in the area of health care law, with emphasis in legal issues facing Medicaid & Medicare providers, including senior and waivered service providers, ICFs/MR, nurses and other licensed health professionals. In addition to providing general counsel advice to his clients on a daily basis, Sam also handles litigation before state and federal civil trial and appellate courts, and before federal and state administrative agencies and boards.

His areas of practice include anti-fraud compliance and litigating fraud issues in Court. He has successfully defended providers in billing practice collections launched by DHS’s SIRS division, in federal civil money penalty claims for allegedly false physician billings, in civil suits brought by the State seeking treble damages for alleged Medicaid fraud, and has consulted with criminal defense lawyers representing clients charged with Medicaid fraud. In addition to helping his clients comply with federal anti-kickback laws, he recently won a treble damage RICO arbitration award over $300,000 for a nursing home that had been defrauded by a temporary employment pool service.

Jessica Bierbrauer, Training Projects Coordinator, MN Department of Human Services
Jessica Bierbrauer is a provider trainer and project coordinator in the Provider Relations training and communications unit at the Minnesota Department of Human Services (DHS). She has worked at DHS since February of 2000, and is an expert in Medicaid billing policies and procedures, and the MN–ITS online billing system. Jessica’s primary responsibilities include planning and conducting provider workshops for Minnesota Health Care Programs (MHCP) providers, county agencies, tribal governments, and managed health care plans; being a main resource for the Provider Call Center and responding to provider phone calls and written inquiries; and developing and distributing MHCP Provider Updates. Jessica specializes in Home Care and Waiver service billing, including Assisted Living. Prior to DHS, she worked at Blue Cross Blue Shield in the National Accounts Department.
